All trading operations executed by the software are performed on the user's own account, under the user's full control and responsibility.
The user is solely responsible for choosing a regulated broker authorized to operate in the user's country of residence.
The user is solely responsible for ensuring their trading activity complies with all applicable laws and regulations in their jurisdiction.
The user has sufficient knowledge and experience to understand the risks involved in algorithmic trading, including the possibility of losing all invested capital.

Elysium Media FZCO is a software development company registered in the Dubai Silicon Oasis Authority (DSOA) free zone. As a software provider, we do not require financial services licensing. However, users must be aware of the following regulatory framework:

SCA — Securities and Commodities Authority

In the UAE, trading in Forex, indices, commodities, and other financial instruments is regulated by the Securities and Commodities Authority (SCA). Users operating within the UAE must ensure their broker is duly authorized by the SCA or an equivalent recognized authority (e.g., DFSA for DIFC entities).

VARA — Virtual Assets Regulatory Authority

If the software is used to trade virtual assets (cryptocurrencies, tokens, or any digital asset), the Dubai Virtual Assets Regulatory Authority (VARA) framework applies. Users must ensure compliance with VARA regulations and use only licensed Virtual Asset Service Providers (VASPs) within the UAE.

International Users

Users outside the UAE are solely responsible for complying with all financial regulations, licensing requirements, and legal obligations applicable in their country of residence. This includes, but is not limited to, EU (MiFID II/ESMA), UK (FCA), USA (SEC/CFTC/NFA), and any other applicable regulatory frameworks. "As-Is" Software Provision

The PMTS software is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Elysium Media FZCO Shall NOT Be Liable For:

Any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the software.
Financial losses resulting from trading operations, market conditions, broker actions, or any other factor beyond our control.
Technical failures, including software bugs, server outages, connectivity issues, execution delays, or data inaccuracies.
Third-party actions, including broker insolvency, regulatory changes, exchange outages, or liquidity provider failures.
Any damages arising from unauthorized access to user accounts or trading terminals.

Maximum Liability

In any event, the total aggregate liability of Elysium Media FZCO shall not exceed the total fees paid by the user to the company during the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Elysium Media FZCO, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

Your use or misuse of the software or services.
Your violation of these Terms & Conditions.
Your trading activity, including any financial losses incurred.
Your violation of any applicable laws, regulations, or third-party rights.
Any claim by a third party arising from your use of the software.

Modifications

Elysium Media FZCO reserves the right to modify these Terms & Conditions at any time. Material changes will be communicated via email or through the platform. Continued use of the service after notification constitutes acceptance of the updated terms.

Termination

Either party may terminate the service at any time. Upon termination, the user must cease all use of the software. Provisions regarding limitation of liability, indemnification, and governing law shall survive termination.
